Brain Candy ("we," "our," or "us") grants you a personal, non-transferable, non-exclusive license to use the Brain Candy application ("Software") for personal, non-commercial purposes only.
2. Restrictions
You may not:
- Use the Software for commercial purposes without explicit written permission
- Modify, reverse engineer, or create derivative works of the Software
- Remove any copyright or proprietary notices from the Software
- Transfer the Software or this license to any third party

4. Intellectual Property
The Software, including all content, features, and functionality, is owned by Brain Candy and is protected by copyright and other intellectual property laws.
5. User-Generated Content
Any media recorded while using the Software may be used for non-commercial purposes, provided that:
- Proper credit is given to Brain Candy
- The content is not used for commercial purposes
- The content does not violate any laws or third-party rights
6. Termination
This license is effective until terminated. Your rights under this license will terminate automatically if you fail to comply with any of its terms.
7. Disclaimer of Liability & Assumption of Risk
The Software contains flashing and strobing light effects that may trigger seizures, loss of consciousness, or other adverse reactions in individuals with photosensitive epilepsy or other medical conditions, even if no prior history exists. Use of the Software may also cause discomfort, dizziness, disorientation, nausea, or other physical or psychological effects.
By using the Software, you acknowledge and agree that you voluntarily assume all risks associated with its use, including any adverse health effects. You further agree that Brain Candy, its owners, employees, contractors, and affiliates shall not be held liable for any injury, loss, damage, or claim arising out of or relating to your use of the Software. If you experience any adverse effects, you should immediately discontinue use and consult a medical professional.
If you are unsure whether the Software is safe for you, consult your physician before use. You are solely responsible for determining whether you should use the Software.
